1) Introduction - This Terms of Service (the “Terms”) govern your access to and use of the PostPark mobile application, website, and related services (the “App” or “PostPark”) operated by Help the World, Help the World, a company with principal place of business at

(“we,” “us,” or “our”). - By creating an account or accessing the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App. 2) Eligibility and Account Registration - You must be at least 13 years old (or the minimum age required by your jurisdiction) to use the App, and if you are under 18 (or your jurisdiction’s age of majority), you must use the App with parental or guardian consent where required. - You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. - You agree to comply with applicable laws and not use the App for unlawful purposes or to post illegal content. 3) User Content and Conduct - User Content: You may post photos, videos, text, comments, listings, storefront items, reviews, ratings, and other content (collectively, “User Content”). You grant PostPark a worldwide, non-exclusive, transferable, royalty-free license to use, display, modify, reproduce, publish, and distribute your User Content in connection with the App and its services, including promotional materials, for the duration of your account and as long as needed for legal purposes. - Prohibited Content and Conduct: You must not post content that is illegal, defamatory, pornographic, harassing, hate speech, violent, incites wrongdoing, or infringes third-party rights. You must not impersonate others, spam, manipulate metrics, or exploit bugs. You must not interfere with the App’s operation or security. - Moderation: We may review, remove, or modify User Content at our discretion, and we may suspend or terminate accounts for violations. You understand that content visibility and search rankings are determined by our algorithms and policies that can change. 4) Listings, Storefronts, and Transactions - Listings: Users may create listings to sell goods or services (collectively, “Listings”). You are responsible for the accuracy of your Listings and compliance with applicable laws, including consumer protection and sales tax requirements. - Storefronts: Users may establish storefronts to showcase multiple Listings. Storefront owners must comply with platform policies and not engage in deceptive practices. - Transactions: If you enable payments through the App, you may perform transactions using supported payment methods. You are responsible for ensuring you have rights to sell the items and for fulfilling orders, refunds, returns, and customer service as required by applicable law and your Listings’ terms. - Fees and Revenue: We may charge fees (e.g., listing fees, transaction fees, subscription fees) as described in the Pricing and Payments section. Fees are non-refundable except as required by law or our policy. - Disputes: We may provide mediation tools, but you may resolve disputes between buyers and sellers directly. We may offer dispute resolution services as a courtesy; this does not create a binding obligation on us beyond what is stated in the agreement. 5) Payments, Refunds, and AdMob Revenue - Payments: If you use paid features, in-app purchases, or storefront transactions, you authorize the collection of payments via our payment processor. You agree to provide accurate payment information and keep it up to date. You are responsible for any taxes or duties related to your transactions. - Refunds: Our refund policy will be described in the Refunds section or in product-specific terms. Refunds are at our discretion unless required by law. - AdMob and Advertising: PostPark integrates Google AdMob for advertisements and revenue generation. By using the App, you consent to the display of ads and data collection for advertising purposes in accordance with AdMob policies and our Privacy Policy. We may also run analytics, A/B testing, and personalized advertising as permitted by law. - Data for Ads: We may share anonymized or aggregated data with advertisers or third parties. We will not share personally identifiable information with advertisers without consent, except as necessary for ad serving and as described in our Privacy Policy. 6) Intellectual Property - Our IP: PostPark and its logo, app design, features, source code (to the extent applicable), and proprietary content are owned by or licensed to us. You may not copy, reverse engineer, decompile, or create derivative works from the App except as permitted by law or with our written consent. - User Content License: As described in Section 3, you grant us rights to use your User Content in connection with the App. - Third-Party IP: You must respect third-party rights in any content you upload. If you believe your IP rights are infringed, contact us with a detailed notice. 7) Privacy and Data Protection - Privacy Policy: Your use of the App is subject to our Privacy Policy, which explains what data we collect, how we use it, and with whom we share it. By using the App, you consent to our data practices described in the Privacy Policy. - Data Security: We implement reasonable security measures but cannot guarantee absolute security. You should use strong passwords and update your devices to mitigate risk. 8) Advertising and Third-Party Content - Third-Party Content: The App may display third-party content, links, or services. We do not endorse or guarantee third-party content; use it at your own risk. - Advertisements: Ads may appear in the App. You may be able to opt out of personalized ads as described in the Privacy Policy or Ad settings, where available. - Sponsored Content: If you post sponsored content or affiliate links, you must clearly disclose sponsorship or affiliate relationships per applicable laws and platform policies. 9) Prohibited Activities and Compliance - You may not clone or replicate the App, circumvent security, harvest data, or use automated systems to access or interact with the App without our permission. - You must comply with the platform’s community guidelines and applicable laws (e.g., consumer protection, advertising standards, and age restrictions). 10) Suspension, Termination, and Content Removal - We may suspend or terminate your access for violations, suspicious activity, or at our discretion, with or without notice. - Upon termination, you may lose access to your account and content, subject to legal obligations and data retention policies. - If required by law or for safety, we may preserve certain content or information. 11) Intellectual Property Complaints and Takedowns - If you believe your IP rights are infringed by content on PostPark, you may submit a complaint in accordance with our DMCA (or local equivalent) policy or your jurisdiction’s applicable takedown procedure. - We will respond to notices in compliance with applicable law. 12) Modifications to the Terms - We may modify these Terms from time to time. If changes are material, we will provide notice (e.g., in-app notification, email). Your continued use after changes constitutes acceptance of the updated Terms. 13) Location-Based Services and Jurisdiction - If the App uses location data, you agree to sharing location information as described in the Privacy Policy. - Governing Law: These Terms are governed by the laws of . You and we submit to the exclusive jurisdiction of the courts located in for any disputes. 14) Disclaimers and Limitation of Liability - The App is provided "as is" and "as available" without warranties of any kind unless required by law. - To the maximum extent permitted by law, we disclaim warranties including fitness for a particular purpose, non-infringement, and merchantability. - Limitation of Liability: In no event will we be liable for indirect, incidental, special, or consequential damages, or for losses of profits, data, or use arising from your use of the App. Our total liability for direct damages is limited to the greater of (a) the amount you paid us in the past 12 months or (b) a specified cap. 15) Indemnification - You agree to indemnify, defend, and hold harmless PostPark and its affiliates, directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your access to or use of the App, including your User Content, violation of these Terms, or infringement of third-party rights. 16) Force Majeure - We are not liable for delays or failures due to events beyond our reasonable control, including acts of God, labor disputes, or government actions. 17) Severability - If any provision is unlawful or unenforceable, the remaining provisions remain in effect, and the affected provision will be replaced with a valid provision that comes closest to the intent. 18) Entire Agreement - These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and PostPark regarding the App. 19) Notices - Notices to PostPark should be sent to info@postpark.org or the address provided in the App. You may contact us via in-app support or email. 20) Special Considerations for AdMob and Compliance - AdMob User Consent: If your region requires consent for personalized ads (e.g., GDPR in the EU), implement a consent management mechanism. Provide clear choices for users to opt in/out of personalized ads. - Data Sharing with Google: You may share data with Google for ad personalization and measurement as described by Google’s policies. Ensure your Privacy Policy explains this data sharing. - App Store Compliance: Ensure your ToS aligns with Google Play and Apple App Store policies, including disclosures for ads, in-app purchases, and user data handling. 21) Compliance and Safety Addenda (Recommended) - Age-Appropriate Content: If your app allows user-generated content, provide guidelines and automatic filters or moderation for age-appropriate content. - Safety Resources: Provide access to safety resources and reporting mechanisms for abuse, copyright violations, or suspicious activity. - Seller Protections: For marketplace transactions, outline seller protections, dispute resolution, and chargeback processes. 22) Data Processing Addendum (DPA) - If you process personal data of residents of the EU or other regions with data localization or processing requirements, include a DPA outlining roles, subprocessors, data transfers, security measures, data subject rights, breach notification, and deletion timelines.
